Spain Reiterates Need To Impose Protectionist Towing Rules

Madrid, Spain (PortSEurope) February 15, 2019 – Spain’s Public Works Ministry has informed the European Commission that it considers necessary the imposition of an obligation of tugboats to operate under Spanish flag to guarantee full compliance with the labour and social conditions contained in the regulation for the provision of port services.

The ministry has verified that the only valid way to ensure full compliance with the obligations of the social and labour regulations that apply in the Member State of the port in question is through the imposition of the requirement to the vessels that provide towing and mooring services to fly the Spanish flag. 

The obligations include the provisions of applicable collective agreements and requirements relating to seafarers’ work and rest periods, as well as compliance with the applicable rules on the inspection of seafarers work.
